Governor Signs Micro-Brewing Legislation;
Additional Alcohol Bills
PIERRE, S.D. – Gov. Dennis Daugaard signed Senate Bill
173 March 22, which removes barriers for microbreweries by increasing the production limit to 30,000 barrels of
beer per year and allowing microbreweries to self-distribute their product.
“This is an economic development win that will help
our homegrown craft breweries grow and thrive,” said
Gov. Daugaard. “Previously, South Dakota law capped
microbreweries at 5,000 barrels of beer per year and prohibited an in-state microbrewery from selling its product
directly to a retailer. The changes will allow us to better
compete with our surrounding states which allow selfdistribution and have higher distribution caps.”
Gov. Daugaard also signed five additional alcoholrelated bills below March 22:
•HB 1313 – an Act to revise certain provisions regarding the licensing of certain alcoholic beverage manufacturers.
•HB 1146 – an Act to revise certain provisions regarding the consumption of alcoholic beverages by passengers aboard vehicles operated by licensed carriers.
•SB 178 – an Act to provide certain exceptions from
alcoholic beverage provisions regarding events conducted by certain civic, charitable, educational, fraternal, or
veterans organizations.
•SB 187 – an Act to establish certain provisions regarding the licensing of wine manufacturers.
•HB 1067 – an Act to revise certain provisions regarding the licensing of wineries.
Gov. Daugaard added, “South Dakota’s alcohol laws
were written over 80 years ago, after prohibition ended,
and they have been amended many times. I thank legislators for passing these bills which streamline and modernize our statutes, so that they make sense for a 21st
Century economy.”
Governor Signs Precision Ag Construction
Legislation; Also Signs Other Bills
PIERRE, S.D. – Gov. Dennis Daugaard has signed two bills
authorizing and funding a precision ag facility at South Dakota State University. The legislation supports the nation’s
first four-year degree in precision agriculture at SDSU.
“The precision ag program at SDSU is preparing students
to navigate the future of our state’s number one industry.
As the landscape of that industry continues to evolve, it
makes sense for the state to partner with the university and
private organizations to invest in this program,” said Gov.
Daugaard.
House Bill 1264 authorizes the construction of the building on SDSU’s campus and provides for renovations of Berg
Agriculture Hall. Senate Bill 183 provides additional funding
for the construction project.
Gov. Daugaard also signed the following bills March 22:
HB 1126 – An Act to revise certain provisions regarding
forensic medical examinations for victims of rape or sexual
offense.
HB 1140 – An Act to revise certain provisions regarding
access to public water.
HB 1172 – An Act to revise certain provisions regarding
meetings of certain public bodies.
HB 1221 – An Act to expand the partners in education
tax credit program to include tribally controlled schools on
a federally recognized Indian reservation.
HB 1252 – An Act to prohibit certain government entities
from restricting the wearing of tribal regalia during certain
events.
HB 1257 – An Act to designate certain highways by town-
ships and counties as no maintenance highways.
HB 1258 – An Act to revise certain provisions regarding
aviation.
HB 1269 – An Act to revise certain provisions regarding
the time frame for consent in adoption proceedings.
HB 1278 – An Act to revise certain provisions regarding
the extradition of fugitives by Indian tribes.
HB 1280 – An Act to revise certain provisions regarding
the calculation of suspended prison sentences.
HB 1293 – An Act to increase the penalty for certain assaults committed against firefighters, ambulance service, or
health care personnel while engaged in the performance of
their duties.
SB 68 – An Act to revise certain provisions regarding
the assistance provided to counties by state firefighting
resources.
SB 98 – An Act to revise certain provisions regarding the
911 emergency surcharge, the public safety 911 emergency
fund, and revenue distribution and to repeal the 911 emergency surcharge sunset clause.
SB 100 – An Act to establish certain provisions related
to grant monitoring and review and to revise certain record
retention policies.
SB 128 – An Act to revise certain provisions regarding
ballot question committees.
SB 155 – An Act to revise certain provisions regarding
the liability of the cost of jail confinement.
SB 156 – An Act to revise certain provisions regarding
brand inspections
Governor Daugaard Proclaims Welcome
Home Vietnam Veterans Day
PIERRE, S.D. – At the request of the South Dakota Department of Veterans Affairs, Gov. Dennis Daugaard has
proclaimed Friday, March 30, 2018, as “Welcome Home
Vietnam Veterans Recognition Day,” calling on all South
Dakotans to recognize the courage, service and sacrifice
of the men and women who served during the Vietnam
War.
Some served as ground troops in a combat capacity
in country, some were a mile off shore in a Navy ship
providing gunfire support, some were air support, while
others provided the necessary support roles both in
Vietnam, other nearby posts and some back in the States
that are so vital during a foreign engagement. Whatever
the specific method of service, all were affected in some
way by that experience.

Signs Veterans
Cemetery Bill
PIERRE, S.D. – Gov. Dennis Daugaard signed Senate Bill
91 March 23 to establish a new state veterans cemetery in
East River South Dakota. The law authorizes the Department of Veterans Affairs to provide for the design and
construction of a cemetery in Minnehaha County on land
donated by the City of Sioux Falls.
“This new veterans cemetery will give veterans a final
resting place close to their homes and families,” said Gov.
Daugaard. “This cemetery has been a longstanding goal
of veterans organizations, and I am pleased to see it come
to fruition.”
The legislation creates the South Dakota Veterans
Cemetery endowment fund within the South Dakota Community Foundation. The endowment fund will provide
a fund for any person who wishes to contribute to the
construction and operation of the South Dakota State
Veterans Cemetery. The foundation’s goal is to reach $3
million by July 2023.
In addition, the state has appropriated $450,000 from
the general fund and $6 million in federal fund expenditure authority to the Department of Veterans Affairs for
the purpose of creating the cemetery.
Senate Bill 91 contains an emergency clause, making
the law effective immediately.
